Take this for what it is - a legal and respectful request for you to remove the images I own from this board.
You have stolen images from www.gagsplus.com while your beef is with www.foggys-funnies.com
The images are posted on this page:

If the images are not removed promptly and before Monday, April 28th, I will bring my lawyers to bear on the issue.
You may attack my site, foggys-funnies.com all you like. You may attack me personally all you like. But you can not and will not be allowed to use the photographs I own copyright to.
The images in question are those posted by STIBROKER. Legal suit would be easily brought against all holdings under the legal entitiy that is the registrar of this domain, as well as the individual whose real name can and will be subpeoned in court, to name STIBROKER.
See, guys, I CAN do this. I own the images. If you alter them I still own them.
I was, at one time, willing to provide credit back to where ever it was needed for a certain set of images on my site. YOU made this all happen - YOU brought this upon yourselves. If you had simply let your leader handle this, none of THIS would have to have happened.
Now you are welcome to go to my forums and act the fool all you like - those guys and gals over there can take care of themselves. It is childish, however, to post one thing over there and run over here and post another. If you can't fight face to face, then why fight at all? It makes you little more than a coward.. and if you really think about it - isn't that what terrorists are?
So within all of this are we to conclude that bresslers.org harbours terrorists? Or it is just populated with them..
One of your members, not too mention your leader, seems to have some sense about them. It's time to listen to them, and stop the silly webwar you have started.

You can't steal images and use them to suit your needs then when they show up on another site try to bully that site into giving you credit.

I was willing to do this because I am an honest person, a person willing to give credit where it is due. If you want to play dumb and threaten me then you must be prepared for what lies ahead of you.

One last thing before I go for the night:
STI - you can twist things around to suit your needs all you like, but you are not fooling anyone who matters. You may fool some other kids, but when it boils right down to it - YOU have no claim to anything. My bet is that you didn't make a single one of the images in question - which in essence gives you no right to speak on them. You are only setting this whole thing back, and it would seem that you are trying to keep it alive, while adding fuel to the fire. I will not ban you from my forums - you are free to act anyway you like. My forums are open, you can be yourself, or you can act the fool. Just don't get all upset when the collective groups show you the door.

You are not banned from my forums. Only I can ban you. You may not be WELCOME in them, but you are free to come and go as you please. And while bigjim may have said some silly things, I am pretty sure he has stopped - while you continue to push.

And BTW, I was toying with your woefully inadaquate obscenety filter. I thought it would filter out all the cuss words that I could dish out. It didn't, except the word "asshole". THAT it filtered just fine. You really need to add more words to that filter. And it was only that ONE message. I left a total of 4, 3 clean, one playing with the filter.
I got such a good laugh at that that I just had to leave it as is. It was classic. :hehe:

I got a nasty reply about threatening Foggy. Apparently, someone sent an e-mail and signed it with my name and e-mail address, which is available on here. I checked the site and yeah, one of mine is on there but I don't care.
I don't blame Foggy for getting pissed because he thought I sent the letter. I blame whoever it was that used my name and address. :mad:
I sent a reply and tried to explain I didn't do it and sent the pic I had done because he wants "proof" it's mine (no way to really do that). I don't care! I told him not to judge all of us because of someone else.

Now this thread is finally getting somewhere. Isn't it much more fun to blast me in your own setting than to try to attack me in my forums? See, since I rarely go into my forums, you are only pissing off the people who do go there - and really they couldn't care less what I do.
Let me address a few of the replies to this thread now.
Big Jim - there is nothing "classic" about posting a string of cuss words. It simply shows you are an immature individual, regardless of WHY you posted them. There is no need to do things like that other than to impress people with your command of the English language.

All of the images were submitted to me, much in the same way they were submitted here to this forum. While you speak on theft, it is possible that the some of the images submitted here have been stolen from elsewhere and posted under false pretense. WRONG. If you steal an image and alter it, that does not make it yours, in any way shape or form. Think about it. If you steal a car and paint it, does that car now belong to you just because you put in all the work to paint it? Hardly. Same thing holds true with copyrights. You simply can't steal something, edit it, and call it your own. In the same respect you might look up the words "slander" and "malice" in your favorite law library.
Pistol Pete - your direct emails to me were the way I would expect an adult to react to this. The original email which came from my contact form was obviously not written by the same person I see posting here. It's nice to see an adult everyone in awhile. If you were the representative for these forums, we would not be in this battle right now. Instead we get Big Jim, STIBROKER and Wreck05 doing the representing.
I have no problem giving credit back to this group - I really don't. I made the clear in my email exchange initially with the owner of this place. However, with everything that has come to bear, I ask you - if you were in my shoes, would YOU want to give credit to this site - given that all I have are the eloquent actions and words of this trio?

KR, you would probably get better results if you were to send JBMoney a private message and discuss this situation with him site owner to site owner, away from the public forum. You will likely get better results than to start a word war here.
Speaking for myself here, but if you are going to use an image that has been posted, a simple credit to this site is acceptable. I feel that is only fair. You are using your site to make a few bucks, so crediting any work done by others that helps you in your endeavor is the right thing to do.

For the record I do not use foggys to "make a few bucks". I used to, in the past, yes. I do carry advertising on the site, yes. I carry advertising more to solidify my brand - which is the foggy caricature stolen by this forum, a brand with is protected under federal trademark law. What I mean is the ads on foggys are for gagsplus.com - a site I own, and a site that is also using my federally trademarked brand logo. Pointing any traffic to a place that is abusing my trademark would not be good business. If it we done in jest, hey - I could deal with that.
Personally I think it is wrong for people to just grab whatever they like, post it, and provide some text to the site they just ripped off. The problem is that there are far too many children running websites these days, children that produce no content, children that steal all of their content - children who assume everyone else is stealing content, so "why should I provide credit - they stole it in the first place" These children, like STI, clueless and actually hurt the internet community as a whole.
Back when foggys funnies was my only site and my main focus of attention, we produce 100% of the content ourselves. We we didn't draw and animate ourselves we have drawn FOR us, and did the cell animation ourselves. Everything had a piece of us in it. Everything was totally original and protected under copyright law. That didn't stop every STI, BigJ and Wrecker from stealing it anyway, posting it as their own, and building sites around nothing more than copy and paste content. The taco bell dog we produced in 97 is probably the single most stolen piece of content on the web today. It is 100% ours - and at one point I did try to ask for a link back from every site I found using it. It spread around too fast to keep up with, and I gave up on the chase, eventually finding that there were webmasters just waiting for us to produce a new piece so THEY had something new to show - to try to keep THEIR traffic base alive and growing. The whole process became frustrating, and we eventually stopped adding new content, focusing rather on commissioning work from others, like zeebarf and gaspirtz. Eventually we tired of this as well, and from 2001-late 2002 we let foggys sit idle, adding no new content for over 18 months. We took our databases and moved on to other projects, like list world and gagsplus. We don't NEED foggys funnies. I have a sentimental attachment to the place, though, and I will keep it up, and just the past couple of months started playing the game like 10,000 other sites are - add content as you find it. The difference is that I require all submissions to come through my submit form. I can prove where the images come from that I use on my site - and in a court of law the worst that can possibly happen is that I will be required to remove any copyright images I may accidentally use. The courts will then go after the person who submitted the images to us for use.
What is happening here is different though. The images that are being altered are NOT the property of the person who alters them. They have no legal claim to them in anyway. So if you guys are really seeking people to link to this forum by threatening them and playing silly kiddie games like STI is so willing to do, you are going to find resistance everywhere you go. Some people are not going to be as willing as I am to talk things over with you as a group, still others have huge loyal followings of their own that will simply jump in your forums and return the same treatment you extend to them.
When creating your images you could TAG them. Create a bresslers logo, and slap it on each and every image you post here. Put it in a place where it can not be easily cut out. Remember, however, that when you do this you are providing the legal evidence which will point the finger back at you - and just one AP photo journalist whose work is altered and tagged can take you to court for copyright infringement.
So you see, you are in a catch-22 position. Tag things and risk that path, don't tag them and send STI out to attack everyone who ends up with one of them on their sites - or be diplomatic about the whole thing, and grow virally and feel good about it at the end of the day.
I bet if you ask JB his take on all of this he'll tell you he just wishes STI and the gang would have let him handle this himself - after all, that is what is job is here. He obviously handles it well.

My presense in this forum is simply to correct things I can the best I can, and attempt the settle this whole thing down face to face with those we feel thier work was stolen. Obviously the attacks on my forums were not going to get us anywhere. In essence I hope to STOP this war, by giving you all the front man behind foggys to slander and abuse in a point of prensence atmosphere.

That recording was taken from a free mp3 site. If the shit were to hit the fan I am fully protected. The law-dogs would have to go after the site distributing the recording, while I would simply have to remove it. Funny thing is that site isn't sending their attack dogs after me to give them credit. Imagine that.

I do not photoshop. I don't really know nor do I care about your allegations personally. All I said was that if I take a picture and digitally alter it I feel it is mine. If I took a picture of two people shaking hands and put two different heads on them I feel it is my picture. Plain and simple.
Please remember that I do not photoshop. So before you accuse me of stealing images without evidence please look up slander.

I didn't post any flames, either, well, just one thinking they have a WORKING censor detector on the board, and it was a joke post after you noted it altered the word "hell". Other than that, there were not flames at all. Except the reply I gave to that asshat on the board last night flaming ME with a reply to a post I left that was respectable in tone. Paranoia is definately the order of the day.

I would have said every Tom Dick and Harry, but it wouldn't have made as much sense. The three of you are the ones who decided to come to my forums - to "kick my ass" or whatever you called it. Actually your gun analogy isn't too far off. There have been numerous cases tried where the gun was the focus - if this person had not given him the gun, he couldn't have committed the crime, that sort of thing. Sure, the guy who killed "someone" gets punished - this is a capitol crime we are are talking about, but in the same respect the OWNER of the gun can be tried as well. In Indiana a law was just passed that makes the owner of a gun used in a felony responsible for punitive damages that are a direct result of the crime. In other words, if a gun registered to you is used to kill someone, YOU can be sued by the family of the deceased for pain and suffering. Hey, if you had protected your gun properly, we wouldn't be here today, that sort of thing.

Hotlinking, in case you don't know, if taking an image that is posted on the owners site and calling that image FROM the owners site. You are borrowing thier content for your own use and making them pay the bill, too. A far cry from using images submitted to you via email and calling them from your own servers.
So yes, it is a LOT different that what I am doing. I am simply using images that were sent to me via my submission form in PPS format, which I had to pull FROM the PPS file and post as static images. Now if you think that editing photos makes them your own, the edit a PPS file makes it MY own, right? I mean I did nothing more than the people who edited the images did in the first place - I took something that looked one way and made it look a different way.
You can keep attacking all you like - I'll keep shooting you down. Makes me no difference either way.
I would think, however, that the least you could do, if you are going to knowingly and willing steal images from someone is to call them from your own servers.

In the end, screaming copyright law abuse is stupid as almost every website that uses any pics that they themselves did not create and did not ask permission from the original copyright owner to use, are in violation of copyright law. What you are saying Foggy has done no wrong posting the images, (that came from an unidentified source), on his website, not the forums. But some had to come and raise hell in the Forums and for What purpose? Credit he didn't know who to give. He is also entitled to "Fair Use".

Actually since Foggy has the song set up for distribution, ie: email this to a buddy. He is in violation of distribution laws on that song. He didn't know who to give recognition, which he has said. I know he does give recognition from paste mails I have sent him, he knew who to credit. And the way some from here tried to get the recognition was down right childish, coming to our forums and throughing a tantrum. They could have come in nicely and opened a disscussion on it, and I'm sure Foggy would have been happy to give the recognition after finding it to be true. Which he has also said.

I wonder if it ever occured to him that if he had given recognition when he found out about it, that this whole ordeal could have been avoided. I would be pretty understanding of their anger. And I would have explained the situation and given recognition to that party. Then if the tirades persisted, I would have more ground on which to walk. To this day there is still no recognition which is all these people were asking for. You talk about our members not acting accordingly while Foggy himself is acting badly.

I was waiting for someone to make this observation. It really makes me wonder if Froggy wants to give credit to anyone at all. I can see his posting these pictures from email submissions, but not know the source. Thats fine. But once the source became known to him, you'd figure that in the very least, as a courtacy between site owners, a link would be provided as to the source of the materials.

I desided that, since I already posted a screenshot of the exchange, I'm not going to repost it verbatim. I posted it as a working censor filter SHOULD have altered it. If you want to read the exchange, it's around. However, it became more obvious at that point that whatever "deal" Froggy struck with JB was more lip service than an actual promise. I left after those three posts, and posted my observations here.
Any followup I made on that board after these three messages are the result of Froggys appearance here threatening some crazy assed lawsuit, and makes me out to be an ogre. Three posts, thats it. If Froggy wants to keep the three ring circuis alive, I will be more than happy to accomidate him
